  • Laboratory Analysis: The transfer and processing of your specimens by accredited reference laboratories.
  • Accuracy of Information: Providing true, accurate, and complete identification and medical disclosures. Falsifying identity, adulterating samples, or tampering with collection protocols constitutes a material breach of these Terms and will result in immediate termination of service and notification of relevant authorities or employers where mandated by law.

6. Privacy, HIPAA, and Texas State Privacy Laws

We treat all protected health information (PHI) and personal identifiable information (PII) with the highest standards of confidentiality.

  • Statutory Compliance: MedaMobil complies with applicable provisions of the Health Insurance Portability and Accountability Act of 1996 (HIPAA), the Texas Medical Records Privacy Act (Texas Health & Safety Code Chapter 181), and the Texas Identity Theft Enforcement and Protection Act (Texas Business & Commerce Code Chapter 521).
  • Third-Party Disclosures: You acknowledge that your samples and necessary identifiers will be shared with certified clinical laboratories, medical review officers (MRO), or designated employer representatives (DER) strictly as required to process tests and deliver authorized results.
  • Full Privacy Details: Please review our full Privacy Policy (which is incorporated into these Terms by reference) to understand our data retention, safeguarding, and disclosure procedures.

7. Texas-Specific Testing & Regulatory Standards

  • Workplace Drug Testing: Drug testing conducted for employment or post-accident purposes conforms with Texas state law, including Texas Labor Code Chapter 411, and where applicable, federal DOT standards under 49 CFR Part 40. Results will be disclosed only to the authorized employer or client contact designated during service intake.
  • Reporting Obligations: Certain health screening results may be subject to mandatory state-level public health reporting pursuant to the Texas Health and Safety Code (e.g., communicable disease notifications to the Texas Department of State Health Services).

8. Accuracy of Testing, False Results, and Retesting

  • While MedaMobil and its laboratory partners use industry-standard collection, security, and analytical methodologies, no screening or test is 100% infallible.
  • Results may be influenced by cross-reactivity, dietary supplements, medications, improper specimen provision by the client, or non-disclosed substances. MedaMobil does not warrant or guarantee that test results will be free from false-positive or false-negative indicators.
  • If a donor disputes a preliminary or confirmed result, retesting or split-specimen analysis must follow established laboratory or DOT dispute protocols at the requesting party’s expense.

You agree not to use the Site or Services to:

  • Provide fraudulent, substituted, or adulterated biological specimens.
  • Impersonate any individual or misstate affiliations with an employer or organization.

No content may be reproduced, modified, or distributed without our express prior written permission.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MEDAMOBIL, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSED PHLEBOTOMISTS/COLLECTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF EMPLOYMENT, LOST WAGES, BUSINESS INTERRUPTION, REPUTATIONAL DAMAGE, OR MEDICAL COMPLICATIONS ARISING OUT OF OR IN CONNECTION WITH:

  • Class Action Waiver: YOU AND MEDAMOBIL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims.
  • Governing Law: These Terms and all disputes shall be governed by and construed under the laws of the State of Texas, without giving effect to any choice of law or conflict of law principles.
